Terms of Service

PropBuyAI (ABN 62 935 573 081), trading as PropBuyAI ("we", "us", "our"), operates the platform located at propbuyai.com.au ("the Service"). Contact: support@propbuyai.com.au

By creating an account or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Definitions

• "User" means any individual or entity that creates an account or uses the Service.
• "Content" means data, property listings, analyses, reports, and any other material generated by or submitted to the Service.
• "Subscription" means a recurring paid plan (Explorer, Investor, Professional, or Agency) that grants access to premium features.
• "Top-up Credits" means one-off purchased credits used to run individual property analyses outside your subscription allowance.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service you represent that you have the legal capacity to enter into a binding agreement.

3. Account Registration and Security

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@propbuyai.com.au if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for an extended period, or are used for fraudulent purposes.

4. No Financial, Legal, or Investment Advice

The Service provides AI-generated property analysis, valuations, rental yield estimates, and investment modelling for informational purposes only. Nothing on the Service constitutes financial advice, investment advice, legal advice, tax advice, or a recommendation to buy, sell, or hold any property.

AI-generated valuations and estimates are approximations based on available data and may differ materially from actual market values. You should always obtain independent professional advice (including from a licensed financial adviser, property valuer, solicitor, or accountant) before making any property purchase or investment decision.

We do not hold an Australian Financial Services Licence (AFSL) and are not authorised to provide personal financial advice under the Corporations Act 2001 (Cth).

5. Use of the Service

You agree to use the Service only for lawful purposes. You must not:

• Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
• Use the Service to scrape, harvest, or collect data for competing products.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent rate limits, usage quotas, or access controls.
• Resell, sublicense, or redistribute access to the Service without our written consent.
• Use the Service for any illegal activity, including money laundering, fraud, or anti-competitive conduct.

6. Subscriptions and Payments

6.1 Free Tier

The free tier includes one (1) AI property analysis for the lifetime of the account. No payment information is required.

6.2 Paid Subscriptions

Paid plans are billed in advance on a monthly or annual basis at the prices displayed on the pricing page at the time of purchase. All prices are in Australian Dollars (AUD) and include GST where applicable.

Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. We may change subscription pricing with at least 30 days' notice. Price changes apply from your next billing cycle after the notice period.

6.3 Top-up Credits

Top-up credits can be purchased at any time and are added to your account balance immediately. Credits do not expire while your account remains active.

6.4 Payment Processing

Payments are processed securely by Stripe. We do not store your full credit card details on our servers. By providing payment information, you authorise us to charge the applicable fees to your nominated payment method.

7. Cancellation and Refund Policy

7.1 Cancellation

You may cancel your subscription at any time from the Settings page or by contacting support@propbuyai.com.au. Cancellation takes effect at the end of your current billing period. You retain access to your plan features until that date.

7.2 Subscription Refunds

No pro-rata refunds or credits are provided for the remaining portion of a billing period after cancellation. If you believe you have been charged in error, contact us within 14 days at support@propbuyai.com.au and we will review your case.

7.3 Top-up Credit Refunds

Top-up credit purchases are non-refundable. Credits are consumed immediately upon use for property analyses and cannot be reversed once an analysis has been generated.

7.4 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Intellectual Property

All intellectual property in the Service (including software, design, branding, and AI models) remains our property or that of our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your active subscription.

You retain ownership of the data you submit to the Service (such as property URLs and notes). You grant us a licence to process that data as necessary to provide the Service.

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

10. Third-Party Data and Services

The Service may display property data sourced from third-party platforms (including publicly available property listing platforms). We do not guarantee the accuracy, completeness, or timeliness of third-party data. Third-party data is provided "as is" and may be subject to those third parties' own terms and conditions.

11. AI-Generated Content

Analyses, valuations, negotiation scripts, and other outputs generated by the Service use artificial intelligence and are inherently approximate. AI outputs may contain errors, omissions, or inaccuracies. You acknowledge that:

• AI valuations are estimates only, not formal property valuations.
• Comparable sales data may be incomplete or outdated.
• Rental yield and cashflow projections are indicative and depend on assumptions that may not hold.
• You should independently verify all AI-generated information before relying on it.

12. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time for maintenance, upgrades, or other operational reasons, with or without notice.

13. Limitation of Liability

To the maximum extent permitted by law (including the Australian Consumer Law):

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total aggregate liability for any claim arising from or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.
• We are not liable for any loss or damage arising from your reliance on AI-generated analyses, valuations, or recommendations.

14. Indemnification

You agree to indemnify and hold harmless PropBuyAI, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law.

15. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may delete your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute arising under or in connection with these Terms.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Service and cancel your subscription.
